Terms of Service

These Terms of Service ("Terms") govern your use of the REMODPOD website and services. By using the site or purchasing a design package, you agree to these Terms. If you do not agree, please do not use our services.

Please note: If you purchase a design package, you will also enter into our Client Services Agreement, which controls the specific project deliverables, timeline, revisions, and refunds. In case of any conflict, the Client Services Agreement governs the specific project.

1. What REMODPOD Is

REMODPOD is a remote design services company. We produce renovation and addition concept designs, floor plans, 3D renderings, and CAD files based on 3D scans, photos, and worksheets provided by you. We are not a licensed contractor, structural engineer, or permit expediter in your jurisdiction.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts. By using the site, you represent that you meet these requirements.

3. Accounts

When you create a client account you are responsible for keeping your login information confidential and for all activity under your account. Notify us immediately of any unauthorized use.

4. Purchasing a Design Package

All pricing is listed in U.S. dollars.
Payment is processed by Stripe. Placing an order constitutes an offer, which we may accept or decline.
Once design work has begun, fees are non-refundable except as described in the Client Services Agreement.
We may decline projects that fall outside our scope, involve unsafe conditions, or involve materials we cannot responsibly design (e.g., complex structural work without engineering).

5. Client Responsibilities

Provide accurate scans, measurements, photos, and worksheet responses.
Confirm design compliance with your local codes, HOA rules, and zoning before construction.
Obtain all required permits and engineering stamps before building.
Hire and supervise all contractors and trades.

6. Intellectual Property

The REMODPOD site, logo, text, and design templates are our property or licensed to us. Upon payment you receive a non-exclusive license to use the final delivered design documents on one property at the address listed on your order. You may not resell, redistribute, or reuse the designs on other properties without written permission.

We retain the right to display anonymized versions of your project in our portfolio and marketing.

7. Acceptable Use

You agree not to:

Upload unlawful, infringing, or malicious content
Attempt to reverse-engineer, scrape, or disrupt the site
Impersonate another person or property owner
Use the service to design anything you do not have legal authority to build

8. Third-Party Services

We link to and rely on third-party services (Stripe, hosting providers, cloud storage, scanning apps such as Polycam, Matterport, and RoomPlan). Your use of those services is governed by their own terms and privacy policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." REMODPOD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DESIGNS WILL BE APPROVED BY ANY BUILDING DEPARTMENT OR HOMEOWNERS ASSOCIATION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT ALLOWED BY LAW, REMODPOD'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE OR A PROJECT SHALL NOT EXCEED THE FEES YOU PAID FOR THAT PROJECT. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING CONSTRUCTION DELAYS OR LOST PROFITS.

11. Indemnification

You agree to defend and indemnify REMODPOD from claims or expenses arising from your construction, use, or modification of the designs, or your breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of ____________, excluding its conflict-of-law rules. You agree to submit to the exclusive jurisdiction of the state and federal courts located in that state.

13. Changes to the Service and Terms

We may update the site, pricing, or these Terms at any time. Material changes will be posted with a new "Last updated" date. Continued use after the change constitutes acceptance.

14. Termination

We may suspend or terminate access for violations of these Terms, for abusive behavior, or if required by law. You may stop using the service at any time; paid projects remain governed by the Client Services Agreement.
